Terms and Conditions
- Scope
These terms and conditions (GTC) apply to all contracts concluded between you and us, KKB Sweets&More Mr. Alwin Basin, Kielende 6, 22885 Barsbüttel (Tel.: 040 41907390, E-Mail: info@kkbsweetsandmore.de ).
- Contract language and storage of the contract text
(1) The language available for the conclusion of the contract is exclusively German.
(2) The contractual terms and conditions, including information on the ordered goods, will be sent to you by email upon acceptance of the contract offer or upon notification of this. We do not store the contractual terms and conditions.
(3) All agreements made between you and us in connection with the purchase contract arise in particular from these General Terms and Conditions, our order confirmation and our declaration of acceptance.
- Conclusion of the contract
(1) The presentation of the goods in our online shop does not constitute a legally binding offer, but rather an invitation to order (invitatio ad offerendum).
(2) By submitting a declaration of intent by clicking the "Order with payment" button in the last step of the ordering process, you submit a binding offer to purchase the selected goods. Immediately after submitting your order, you will receive an order confirmation, which, however, does not constitute acceptance of your contractual offer.
(3) A contract between you and us is concluded as soon as we accept your order by a separate email or message or ship the goods. Please check your email inbox and your messages regularly.
(4) If delivery of the goods you ordered is not possible, for example because the corresponding goods are not in stock, we will refrain from accepting the order. In this case, a contract will not be concluded. We will inform you immediately and promptly refund any consideration already received. If the product you ordered is only temporarily unavailable, we will inform you of this in the order confirmation.
- Delivery conditions
(1) Shipping costs may apply in addition to the stated product prices. Further details regarding any applicable shipping costs can be found in the respective offers.
(2) Any shipping costs incurred will be shown separately in the invoice
- pay
Prepayment
If you choose to pay in advance, we will send you our bank details in a separate email and deliver the goods after receipt of payment.
PayPal
If you select the payment method PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), we will give you our PayPal email address and deliver the goods after receipt of payment.
- Prices
All prices are gross prices including statutory VAT and are exclusive of any shipping costs.
Discounts:
- Products that already have a special offer price due to the sale are excluded from further discounts.
- Right of withdrawal
Consumers are entitled to the statutory right of withdrawal, as described in the cancellation policy. Businesses are not granted a voluntary right of withdrawal.
- Retention of title
(1) The goods remain our property until full payment has been made.
(2) The following applies additionally to entrepreneurs: We retain title to the goods until all claims arising from an ongoing business relationship have been settled in full. You may resell the reserved goods in the ordinary course of business; you assign to us in advance all claims arising from this resale – regardless of whether the reserved goods are combined or mixed with a new item – in the amount of the invoice amount, and we accept this assignment. You remain authorized to collect the claims; however, we may also collect claims ourselves if you fail to meet your payment obligations. We will release the securities to which we are entitled at your request to the extent that the realizable value of the securities exceeds the value of the outstanding claims by more than 10%.
- Transport damage
(1) The following applies to consumers: If goods are delivered with obvious transport damage, please report such defects to the delivery person as soon as possible and contact us immediately. The damage report must be submitted within 7 working days of receipt of the goods. Unfortunately, we cannot process any damage reports submitted later.
(2) For entrepreneurs, the following applies: The risk of accidental loss and accidental deterioration shall pass to you as soon as we have delivered the item to the freight forwarder, the carrier or the person or institution otherwise designated to carry out the shipment.
- Warranty and guarantees for sales of goods
(1) Statutory liability for defects applies. Unless expressly agreed otherwise below, statutory liability for defects applies.
(2) If the goods purchased and delivered in our online shop are defective, you are entitled, within the framework of the statutory provisions, to demand subsequent performance, to withdraw from the contract or to reduce the purchase price.
(3) The limitation period for warranty claims for the delivered goods is two years from receipt of the goods. Claims for defects that we have fraudulently concealed shall expire within the regular limitation period.
(4) An additional guarantee for the goods delivered by us only exists if this was expressly stated in the order confirmation for the respective article.
- Liability
(1) We shall always be liable without limitation for claims based on damages caused by us, our legal representatives or vicarious agents
- in case of injury to life, body or health,
- in the event of intentional or grossly negligent breach of duty,
- in the case of guarantee promises, if agreed, or
- insofar as the scope of application of the Product Liability Act is open.
(2) In the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, liability shall be limited to the damage foreseeable at the time the contract was concluded and which must typically be expected to occur.
Otherwise, claims for damages are excluded.
